Applicable law and jurisdiction

This document defines the legal framework applicable to relationships between TutinGo, teachers and students, as well as dispute resolution procedures.

1. Applicable law

These general conditions and use of the TutinGo platform are governed by the laws of the Kingdom of Morocco, particularly:

1.1 Reference texts

• Law No. 31-08: Enacting consumer protection measures
• Law No. 09-08: On the protection of individuals with regard to the processing of personal data
• Law No. 53-05: On the electronic exchange of legal data
• Code of Obligations and Contracts: Governing contracts and commercial obligations

2. Jurisdiction

In case of dispute relating to the interpretation or execution of these conditions, and failing amicable resolution, the Moroccan courts shall have sole jurisdiction.

This jurisdiction clause applies even in case of multiple defendants or third-party claims.

3. Dispute resolution

3.1 Amicable resolution

Before any legal action, the parties undertake to attempt to resolve their dispute amicably:

1. Contact TutinGo customer service with problem description
2. Review of file by our mediation team (deadline: 5 business days)
3. Proposal of amicable solution acceptable to both parties

3.2 Mediation

If no amicable agreement is found, the parties may resort to mediation before any legal proceedings. Mediation costs are shared equally between the parties.

3.3 Legal action

In case of failure of amicable resolution and mediation, the parties may refer to the competent courts of Casablanca.

4. Mediation and arbitration

4.1 Conventional mediation

The parties may agree to resort to mediation by an approved professional mediator. Mediation offers the following advantages:

• Fast process (generally 2 to 4 weeks)
• Reduced costs compared to legal proceedings
• Confidentiality of exchanges

4.2 Arbitration

For disputes exceeding 50,000 MAD, the parties may agree to arbitration in accordance with Moroccan arbitration law.

5. Consumer protection

In accordance with Law No. 31-08 on consumer protection, students benefit from specific rights.

5.1 Consumer rights

Students (consumers) have the following rights:

• Right to clear and transparent information about services
• 14-day right of withdrawal (under conditions)
• Right to fair and reasonable price
• Protection against unfair commercial practices

6. E-commerce regulations

TutinGo complies with legal obligations relating to e-commerce in Morocco:

• Complete pre-contractual information (prices, service characteristics)
• Written order confirmation (confirmation email)
• Electronic invoice compliant with legislation
• Compliance with delivery deadlines (or service execution)

7. Personal data protection

Processing of personal data on TutinGo complies with Law No. 09-08 on the protection of personal data.

Artudeve undertakes to respect the principles of lawfulness, loyalty, transparency, purpose limitation, data minimization, accuracy, storage limitation, and integrity and confidentiality.

TutinGo is primarily intended for users residing in Morocco. International users expressly accept that Moroccan law applies.

For European Union users, certain GDPR provisions may apply in addition to Moroccan law.

9. Severability clause

If one or more provisions of these general conditions are held invalid or declared as such pursuant to a law, regulation, or following a final decision by a competent court, the other provisions shall retain their full force and scope.

10. Applicable language

These conditions are written in French, English, and Arabic. In case of divergence of interpretation, the French version prevails.
